Terms of Service

These terms are the agreement between you and ForeWay Ltd for use of the ForeWay website and apps. By creating an account you agree to them.

1. Who we are

ForeWay is operated by ForeWay Ltd, registered in England and Wales, company number [COMPANY NUMBER], registered office [REGISTERED ADDRESS]. Contact: hello@foreway.co.uk.

2. Your account

• You must be at least 13 to create an account.
• You are responsible for keeping your sign-in details secure and for activity on your account.
• The information you give us should be accurate, and kept up to date.
• One account per person. Do not share an account with others.

3. The service

ForeWay lets you record golf rounds, organise events and tours, track performance and receive AI-generated insights. We offer a free tier and paid Plus and Pro plans.

We develop the product continuously. Features may be added, changed or removed. If we remove something significant from a plan you are paying for, we will tell you and you may cancel for a pro-rata refund of the unused period.

4. Subscriptions and payment

• Paid plans are billed monthly or yearly in advance, at the price shown at checkout.
• Card payments are processed by Stripe. Bitcoin and Lightning payments are processed by OpenNode. We never see your card details.
• Subscriptions renew automatically at the end of each period until you cancel.
• If we change our prices, we will give you at least 30 days notice before it affects you, and you may cancel before it takes effect.
• If a payment fails, we may suspend access to paid features until it is resolved.

5. Cancelling, and your 14-day right to change your mind

Your statutory cancellation right

As a consumer in the UK you normally have 14 days from purchase to cancel and receive a full refund, under the Consumer Contracts Regulations 2013.

Because ForeWay gives you access to paid features immediately, at checkout we ask you to agree that the service starts straight away and to acknowledge that you lose this 14-day right once it has been fully performed. If you have begun using paid features within the 14 days, we may reduce any refund to reflect what you have used.

Cancelling at any time

You can cancel from your account settings whenever you like. Cancellation takes effect at the end of your current billing period — you keep paid features until then, and are not charged again. We do not pro-rata refund part-used periods except where section 3 applies or where required by law.

Bitcoin and Lightning payments

Payments made in Bitcoin cannot be reversed, and the value of Bitcoin moves. Where we agree a refund on a Bitcoin payment, we will refund the pound sterling value of your payment at the time it was made, and we may issue it as account credit or to a Bitcoin address you provide. We cannot guarantee the Bitcoin amount returned will match the amount sent.

Your rights if something is wrong

Nothing here affects your rights under the Consumer Rights Act 2015. If the service is not as described, or is not provided with reasonable care and skill, you may be entitled to a repeat performance or a refund.

6. Acceptable use

You agree not to:

• Submit false scores, manipulate handicaps, or interfere with the fairness of any event, tour or leaderboard
• Harass, abuse or impersonate other players
• Upload unlawful, offensive or infringing content
• Attempt to access accounts, data or systems you are not entitled to
• Scrape, resell or redistribute our course data, or use automated tools to overload the service
• Reverse engineer the service, except where the law allows it

We may remove content, correct scores, or suspend or close accounts that breach this section. Where it is reasonable to do so, we will tell you why.

7. Course data and distances

Course maps, yardages and pin positions are assembled from public mapping data and third-party sources, and are improved over time. They are provided for general guidance only. Distances may be inaccurate, out of date, or wrong for the day’s pin position.

Do not rely on ForeWay distances where accuracy matters, including in competition. Check your competition’s rules on distance-measuring devices before using the app during play.

8. AI features

Our AI insights and coaching notes are generated automatically from your round data and may be incomplete or wrong. They are not professional coaching, medical, or fitness advice. Use your judgement, and consult a qualified professional where it matters.

To produce them we send the relevant round data to Anthropic, as described in our Privacy Policy.

9. Your content

Your rounds, scores, photos and notes remain yours. You grant us a licence to store, process and display that content for the purpose of operating the service — including showing your scores to other players in events you join.

We may use aggregated, anonymised data to improve course information and product features. This cannot identify you.

10. Availability

We aim to keep ForeWay running but do not guarantee uninterrupted access. The service may be unavailable for maintenance, or because of failures at providers we depend on. Features labelled beta or experimental may change or be withdrawn without notice.

11. Our liability

We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.

Subject to that, we are not liable for loss that was not reasonably foreseeable, for lost profits or business opportunity, or for the result of you relying on distances or AI outputs contrary to sections 7 and 8. Our total liability in any 12-month period is limited to the greater of £100 or the amount you paid us in that period.

12. Ending this agreement

You may close your account at any time from settings. We may suspend or close your account if you materially breach these terms, or if we stop providing the service — in which case we will give reasonable notice and refund any unused paid period.

On closure, your data is deleted as described in our Privacy Policy.

13. Changes to these terms

We may update these terms. If a change materially affects your rights we will give you at least 30 days notice, and you may cancel before it takes effect. Continuing to use ForeWay after that means you accept the change.

14. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live elsewhere in the UK, you may bring proceedings in your own jurisdiction.
